CIEL Statement on IACHR Precautionary Measures regarding defender in Nicaragua

Washington, DC—Recognizing the active threat to Nicaraguan environmental defender, Olman Salazar Umanor, the Inter-American Commission on Human Rights has requested the adoption of Precautionary Measures to protect Mr. Salazar Umanor and his family. Mr. Salazar Umanor is a member of the National Environmental Movement Against Industrial Mining (MONAFMI) and Coordinator of the Santa Cruz de la India Community Movement. The Center for International Environmental Law (CIEL) acknowledges the resolution as a step toward necessary protections for the land and human rights defender.
After careful consideration of the current context in Nicaragua and the history of repercussions that Olman Salazar Umanor has faced in connection with his activities as an environmental defender, the Commission recognized that his rights to life and personal integrity are at serious and urgent risk. Taking into account the elements of risk, it further recognized that the situation extends to his nuclear family. Consequently, the Commission has requested that the State of Nicaragua adopt precautionary measures with the goal of ensuring the beneficiaries’ rights are respected according to international human rights law, both by state actors and in relation to acts attributable to third parties.
The Commission has condemned increasing harassment in Nicaragua against human rights defenders and others who have voiced opposition to the Government, as well as against victims of human rights violations and their families.
In the present case, the Commission has specifically requested that the State of Nicaragua adopt the necessary measures to secure Olman Salazar and his family’s rights to life and personal integrity after consulting and agreeing with the beneficiaries themselves about what measures to implement. Additionally, the Commission has requested that the State of Nicaragua initiate an investigation regarding this situation to prevent it from reoccurring. It established a deadline of 15 days to receive information from the Nicaraguan government regarding the implementation of these measures.

Comisión Interamericana de Derechos Humanos solicita al Estado de Nicaragua que adopte medidas para proteger defensor ambiental y su familia
Declaración de CIEL sobre Medidas Cautelares para defensor en Nicaragua
Washington, D.C. —Al reconocer el riesgo actual del defensor ambiental Olman Salazar Umanor, la Comisión Interamericana de Derechos Humanos solicitó la adopción de Medidas Cautelares para proteger al Sr. Salazar y a su familia. El Sr. Salazar Umanor es miembro del Movimiento Nacional Ambientalista Frente a la Minería Industrial (MONAFMI) y Coordinador del Movimiento Comunal de Santa Cruz de la India. El Center for International Environmental Law (Centro para el Derecho Ambiental Internacional) reconoce que esta Resolución es un paso más para lograr las protección necesaria del defensor de tierras y derechos humanos.
Tras cuidadoso análisis del contexto actual en Nicaragua y la historia de repercusiones que Olman Salazar Umanor ha enfrentado durante sus actividades como defensor ambiental, la Comisión reconoció que los derechos a la vida e integridad personal del Sr. Salazar Umanzor están en situación de gravedad y urgencia. Tomando en consideración los elementos de riesgo, reconoció además que la situación se extiende a su familia nuclear. Por lo tanto, la Comisión solicitó que el Estado de Nicaragua adopte medidas cautelares con el fin de asegurar que los derechos de los beneficiarios sean respetados de acuerdo al derecho internacional de los derechos humanos tanto por agentes del estado como por actos atribuibles a terceros.
La Comisión ha condenado el aumento de hostigamiento en Nicaragua en contra de defensores de derechos humanos y quienes se han manifestado en oposición al gobierno, así como en contra de víctimas de violaciones de derechos humanos y sus familiares.
En este caso, la Comisión solicitó específicamente que el Estado de Nicaragua adopte las medidas necesarias para garantizar los derechos a la vida e integridad personal de Olman Salazar Umanzor y su familia después de que se acuerden las medidas a implementar con los beneficiarios mismos. Adicionalmente, la Comisión solicitó al Estado de Nicaragua iniciar una investigación con respecto de la situación para evitar su repetición, y estableció un plazo de 15 días para recibir información del gobierno nicaragüense sobre la implementación de dichas medidas.
